Purpose and scope
These terms govern the relationship between GBE MI SARL, operator of the Gbé Mi service, and anyone using the app, this website or the vehicles it makes available.
They add to, and do not replace, the traffic rules in force in the Republic of Benin.

Definitions
- Service
- The fleet of electric scooters, the mobile app, this website and customer support, taken together.
- Vehicle
- An electric scooter from the Gbé Mi fleet, identified by a number visible on the frame and a QR code on the handlebar.
- Pass
- A time-limited right of use, bought in the app, sometimes carrying a quota of minutes.
- Ride
- The period between unlocking a vehicle and closing the ride in the app.
- Green zone
- An area where riding and parking are allowed, and where a ride can be closed.
- Red zone
- An area where riding and parking are forbidden.

Who can use the service
- You must be at least 18 years old.
- You need a compatible phone, an internet connection and a valid Mobile Money payment method.
- You must be physically fit to ride an electric scooter, and not under the influence of alcohol, vigilance-altering medication or drugs.
- You must know and follow the applicable traffic rules.

Your account
Your account is strictly personal. You are responsible for keeping it confidential and for every ride taken from it, including by anyone you lent it to.
- The information you enter must be accurate and kept up to date.
- One account per person. Duplicate accounts may be closed without notice.
- Tell us immediately if you suspect unauthorised access to your account.

Passes, prices and payment
Access to vehicles requires an active pass. Passes and their prices, in CFA francs (XOF), are shown in the app before every purchase.
- Payment is made by Mobile Money through our provider PayDunya. The pass activates as soon as payment is confirmed.
- A pass has a validity period. Time left unused at expiry is lost.
- Some passes include a minute quota; others are unlimited within their validity.
- Unlock fees may apply each time a vehicle is opened. Some passes remove them.
- Several passes may be active at once. The service consumes the one closest to expiry first.
- A valid promo code reduces the pass price. The final amount is shown before you confirm payment.
- Passes are neither refundable nor transferable, except where a service failure is our fault.
We may change prices. A change never applies to a pass you already bought.

How a ride works
- Inspect the vehicle before you leave: brakes, tyres, lights, handlebar. Do not ride a vehicle that looks faulty — report it.
- The ride starts at unlock and the clock begins immediately.
- The app must stay connected during the ride. A prolonged loss of connection may close the ride automatically.
- The ride ends when you close it in the app, inside a green zone. Until then, time keeps running.
- A ride left open may be closed by our teams or automatically, in particular when the quota runs out or the vehicle stops moving.

Zones and parking
The map in the app is authoritative. It is updated continuously and overrides any earlier information.
- Parking is allowed in green zones only, and in a way that blocks no pedestrian, vehicle, doorway or gutter.
- Riding in a red zone is forbidden. Time spent there is measured and may result in a penalty.
- A vehicle left outside a green zone may trigger recovery charges, and time may keep being billed.

Riding rules
- One rider per vehicle. No passengers, no bulky loads.
- Wearing a helmet is strongly advised. Gbé Mi does not supply one.
- Riding under the influence of alcohol or drugs is forbidden.
- Riding on expressways and in areas closed to personal mobility devices is forbidden.
- Modifying, dismantling, moving out of service or tampering with a vehicle is forbidden.
- Using the service to transport people or goods commercially requires our prior written agreement.

Charges, penalties and debts
Some breaches carry charges, calculated when the ride closes and shown in the app.
- A penalty for time spent in a red zone.
- Recovery charges for a vehicle parked outside a green zone.
- Repair charges for damage caused by your use.
- Replacement value if the vehicle is lost or stolen while the ride is assigned to you.
If an amount cannot be collected, it is recorded as a debt attached to your account. While a debt is outstanding, access to vehicles may be suspended and settlement may be required before you can buy another pass.

Responsibilities
Yours
- You are responsible for how you ride, for following traffic law, and for any damage you cause to others or their property.
- You are responsible for the vehicle for the whole ride, until it is actually closed.
- It is up to you to check that you have insurance cover suited to your use.
Ours
- We maintain the fleet and make vehicles available in working order.
- We do not guarantee that a vehicle will always be available in a given place, nor that the service will run without interruption — for instance during network failures, maintenance or force majeure.
- We cannot be held liable for damage resulting from use that breaches these terms or traffic law.

Suspension and account closure
We may suspend or close an account, with prior notice except in urgent cases, for serious or repeated breaches of these terms, fraud, unpaid debt, endangering others or deliberate damage to a vehicle.
You can close your account at any time from the app or from the Delete my account page on this site. Active passes are not refunded.

Personal data
How we handle your personal data is set out in our privacy policy, which forms part of these terms.

Intellectual property
The Gbé Mi brand, logo, app, this website, their content and their code belong to GBE MI SARL. Any reproduction or reuse without written permission is forbidden.

Changes to these terms
We may change these terms as the service or the law evolves. The version that applies is the one published on this site on the date of your ride. For any substantial change, you are told in the app before it takes effect.

Governing law and disputes
These terms are governed by the law of the Republic of Benin.
If a dispute arises, write to support@gbemibenin.com first: we look for an amicable solution. Failing agreement, the dispute falls to the competent courts of Cotonou.
